These Terms of Use regulate the access and use of the mobile application for smartphone called Piola App available on Google Play and App Store (the "Mobile App"), as well as the website hosted under the domain  www.piolapp.com  ("Website")  as well as the content and services that the Website and the Mobile App make available to its users (the "Users").

In compliance with article 10 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce, the following identification data of the owner of the Website is exposed:

Access to the Website and the Mobile App or their use by the User necessarily implies, and without reservation, knowledge and acceptance of these Conditions of Use. Therefore, it is recommended that the User read them carefully each time they want to access to the Website or enter the Mobile App.

USE OF THE WEBSITE AND MOBILE APPS

Users will be entirely responsible for the correct use of the Website and the Mobile App subject to current legislation, whether national or international, as well as the principles of good faith, morality, good customs and public order, and with the commitment to diligently observe any additional instructions that may be given by PIOLA APP

Users shall refrain from using the services and contents of the Website for illicit purposes or effects and that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect or deteriorate the operation of the Website and the Mobile App, its contents and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of the Website and Mobile App by other Users.

Our antivirus system is reasonably secure. For all these reasons, Piola App is not responsible for the potential damages or errors that, due to the presence of any virus, the computer system (hardware or software) of the Users may suffer when they access the Website and Mobile App or use.

RESPONSIBILITY OF  PIOLA APP

PIOLA APP will make reasonable means available to the User so that the content and services included on the Website and the Mobile App are accurate and up-to-date. However, PIOLA APP is not in a position to guarantee this circumstance at all times. Likewise, PIOLA APP will not be responsible for the operation of the communication networks that enable the operation of the Website and mobile App, whether fixed or mobile, whose responsibility lies entirely with providers outside PIOLA APP.

If it deems it appropriate, PIOLA APP may immediately suspend the provision of the service and, where appropriate, remove the content it deems incorrect or illegal, whether it does so at its sole discretion, or at the request of an affected third party or competent authority, without said suspension giving rise to any compensation.

PIOLA APP does not assume any responsibility derived from the links (links) that allow, through the Website and Mobile App, the User access to benefits and services offered by third parties, provided that they are unrelated to the Website and the Mobile App. Therefore, PIOLA APP is not responsible for the information contained therein or for any effects that may arise from said information. Likewise, PIOLA APP reserves the right to withdraw, unilaterally and without prior notice, the links that appear on the Website and Mobile App.

If any User or third party observes that such links may be contrary to law, morality or public order, they must inform PIOLA APP via email  piolaapp@gmail.com

INTELLECTUAL AND INDUSTRIAL PROPERTY

PIOLA APP is the owner or licensee of all intellectual and industrial property rights included in the Website and Mobile App, as well as the content accessible through them.

The intellectual property rights of the Website and Mobile App, as well as the texts, images, graphic design, navigation structure, information and content contained therein are the property of PIOLA APP, who is the exclusive exercise of the rights of exploitation of the same in any way and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with the Spanish legislation on intellectual and industrial property rights.

Authorization to the User to access the Website and Mobile App does not imply a waiver, transmission, license or total or partial transfer of intellectual or industrial property rights by PIOLA APP, for which its use is strictly prohibited.

MODIFICATIONS TO THE TERMS OF USE

PIOLA APP  reserves the right to modify these Conditions of Use in accordance with the applicable legislation at any time, which it will duly inform on the Website and Mobile App, for which it recommends the User to review them periodically to be informed of how PIOLA APP protects your information.

APPLICABLE LAW AND JURISDICTION

These Terms of Use are subject to the Spanish legal system.

For the resolution of any conflict that may arise from access to the Website and Mobile App, the User and PIOLA APP expressly agree to submit to the courts and tribunals of the city of Madrid, waiving any other general or special jurisdiction that may apply. .
